Ohio AG Sues Loan Modification Company For Fraud Ohio Attorney General Mike DeWine has announced a lawsuit against K&R Marketing LLC, doing business in Broadview Heights, Ohio, as Fix My Mortgage Problem. The lawsuit charges the business and its owner with multiple violations of state consumer laws, including failure to deliver.

According to the attorney general's office, K&R Marketing told consumers that it would work with their mortgage companies to modify their loans for up-front fees between $500 and $1,000. After accepting the down payment, the company did little to aid consumers and did not provide refunds.

DeWine's lawsuit charges K&R Marketing and its owner, Chris Bray, with multiple violations of the Consumer Sales Practices Act, including failure to deliver and failure to provide refunds. It also charges the business and its owner with violating the Debt Adjusters Act by offering loan modifications and charging fees greater than allowed by law. The lawsuit seeks a permanent injunction, consumer restitution and civil penalties.

‘This company was misleading consumers,’ DeWine says. ‘Consumers said they paid fees for loan modification help, but never received assistance. Homeowners who are trying to prevent foreclosure on their homes should avoid businesses that charge up-front fees for their services.’
